AmpFi App LLC – Terms of Service

1. Acceptance of Terms

By accessing or using the AmpFi App (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Nature of the Service

AmpFi App LLC (“Company,” “we,” “our,” or “us”) provides a software tool that connects to your cryptocurrency exchange account via API keys you provide.

The Service does not take custody of your funds.

You remain solely responsible for all trades executed through your account.

3. Eligibility

You must be at least 18 years old and legally able to trade on the connected exchange.

You are responsible for ensuring use of the Service is permitted in your jurisdiction.

4. No Investment Advice

The Service is not an investment advisor, broker-dealer, or money manager. Information or algorithms provided by the Service are for informational and automation purposes only and should not be construed as personalized financial advice.

5. Risks

Trading cryptocurrencies involves significant risk, including total loss of capital. Past performance does not guarantee future results.

The Service operates on APIs; delays, outages, or exchange restrictions may result in missed or unintended trades. You agree to use the Service at your own risk.

6. User Responsibilities

  • Maintain the confidentiality of your exchange API keys.
  • Monitor your trades and account balances regularly.
  • Ensure your connected exchange account has sufficient funds and complies with its own Terms.

7. Fees & Payment

Subscription fees are charged as described on our pricing page. All fees are non-refundable except where required by law.

8. Marketing Communications & Email Consent

By using the Service, you may receive email communications from us. We distinguish between two types of emails:

8.1 Operational and Bot Alert Emails

These are essential service-related communications that you will receive regardless of your marketing preferences, including:

  • Account verification and security notifications
  • Bot trading alerts and performance updates
  • Risk management notifications and warnings
  • Subscription and billing confirmations
  • Service updates and critical system notifications
  • Support responses and account-related communications

These operational emails are necessary for the Service to function properly and cannot be disabled.

8.2 Marketing Communications

Marketing communications include promotional emails, newsletters, product updates, educational content, special offers, and other marketing materials. By default, marketing communications are enabled when you create an account, but you can opt-out at any time.

Your Consent and Control: You can enable or disable marketing email notifications at any time through the Settings page of your dashboard. By default, marketing communications are enabled, but you may opt-out at any time. Your marketing preferences can be changed at any time, and we will honor your choices within a reasonable timeframe (typically within 48 hours).

Opt-Out Rights: Every marketing email we send includes an unsubscribe link that allows you to opt-out of future marketing communications. You may also opt-out by:

  • Adjusting your email preferences in your account Settings page
  • Contacting us at io@ampfi.app with your request
  • Clicking the unsubscribe link in any marketing email

Compliance: We comply with applicable email marketing laws, including the CAN-SPAM Act (United States), GDPR (European Union), and other relevant regulations. We will not send marketing emails to users who have opted out, and we will process opt-out requests promptly.

Third-Party Marketing: We do not sell your email address to third parties for their marketing purposes. However, we may use service providers to send marketing emails on our behalf, subject to strict confidentiality agreements.

9. Limitation of Liability

To the fullest extent permitted by law, AmpFi App LLC is not liable for any loss, damage, or expense arising from use of the Service, including but not limited to trading losses, system outages, or third-party failures.

10. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for violation of these Terms or applicable law.

By accessing and using this website, you agree to comply with the following terms:

Enforcement

Violation of these terms may result in immediate termination of access, legal action, and reporting to appropriate authorities.

12. Intellectual Property

The Service, including all software, algorithms, content, trademarks, logos, and other materials, is owned by AmpFi App LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

You retain ownership of any content you create or upload to the Service. By using the Service, you grant us a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing the Service to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless AmpFi App LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service,
  • Your violation of these Terms,
  • Your violation of any applicable laws or regulations,
  • Your trading activities and decisions,
  • Any content you submit or transmit through the Service.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any other legal documents referenced herein, constitute the entire agreement between you and AmpFi App LLC regarding the Service and supersede all prior agreements and understandings.

17. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of laws principles. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Wyoming, USA.
